Dear Governor Parson, I am writing to you with an urgent plea regarding the case of Marcellus Williams, who is scheduled for execution on September 24. The evidence in this case demands immediate attention and action to prevent a grave miscarriage of justice. On August 11, 1998, Felicia Gayle was tragically murdered in her home. The crime scene was covered with forensic evidence, including fingerprints, footprints, hair, and trace DNA on the murder weapon. Importantly, none of this evidence links Mr. Williams to the crime. Instead, his conviction was based on the testimony of two unreliable witnesses incentivized by promises of leniency and reward money. Nine years ago, the Missouri Supreme Court recognized the need to review DNA evidence and appointed a special master for this purpose. DNA testing conducted in 2016 proved that Mr. Williams was not the source of male DNA found on the murder weapon. Despite these critical findings, no court has substantively considered this exculpatory evidence. Former Governor Greitens, recognizing the doubts about Mr. Williams’s guilt, stayed his execution and convened a Board of Inquiry, which was later dissolved without a report or recommendation by your administration. It is within your power to stay Mr. Williams’s execution and allow the circuit court to review the new DNA evidence. This would give the court the opportunity to carefully consider the evidence and assess the St. Louis County Prosecuting Attorney’s determination that there is clear and convincing evidence of Mr. Williams’s innocence. Given that no court has reviewed this evidence, a stay of execution is the least that should be granted to ensure that Missouri does not take the life of an innocent man. I urge you to intervene and prevent the execution of Marcellus Williams, a man whose innocence is supported by substantial evidence that has yet to be adequately reviewed by the courts. Thank you for your attention to this critical matter.
