Dear Attorney General Bailey, I am writing to implore you to cease opposing the exoneration of Marcellus Williams and to reconsider the stance your office has taken on cases involving individuals who have been wrongfully convicted. The evidence in Mr. Williams’s case clearly indicates his innocence, and continuing to fight against this exoneration not only undermines justice but also endangers an innocent life. Felicia Gayle’s tragic murder in 1998 resulted in a crime scene rich with forensic evidence, including fingerprints, footprints, hair, and DNA on the murder weapon. Importantly, none of this evidence implicates Marcellus Williams. His conviction relied primarily on the dubious testimony of two informants who had significant incentives to fabricate their stories. These informants provided inconsistent and unverified accounts that contradicted each other and the crime scene evidence. In 2016, DNA testing confirmed that Mr. Williams was not the source of the male DNA found on the murder weapon. Despite this, your office has continued to oppose his exoneration. This resistance has prevented substantive judicial review of this critical exculpatory evidence. Moreover, the dissolution of the Board of Inquiry by Governor Parson, without issuing a report or recommendation, has further obscured the truth and denied Mr. Williams a fair evaluation of his case. The St. Louis County Prosecuting Attorney has reviewed the DNA evidence and concluded that Mr. Williams is actually innocent, filing a motion to vacate his conviction. This motion is pending, yet the Missouri Supreme Court has set an execution date. It is imperative that your office supports the judicial process by allowing a fair and thorough review of the new evidence, rather than opposing it at every turn. The role of the Attorney General’s office should be to uphold justice, not to perpetuate wrongful convictions. By continuing to fight against exonerations, especially in cases where compelling evidence of innocence exists, your office risks losing public trust and, more gravely, the possibility of executing innocent individuals. This is not just a legal issue but a moral imperative. I urge you to stop opposing Marcellus Williams’s exoneration and allow the courts to fully consider the new DNA evidence. Upholding justice means correcting past errors and ensuring that no innocent person is wrongfully punished. Your leadership in this matter could restore faith in our justice system and demonstrate a true commitment to justice. Sincerely,
